Letterboxx App Terms of Service

Scope: These Terms apply to the Letterboxx app and related services (the "Services"), unless a separate product-specific agreement says otherwise.

1. Acceptance of these Terms

By downloading, installing, accessing, or using the Services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Who may use the Services

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. The Services

Letterboxx Software provides software applications and related websites that help you organize, read, and manage email newsletters and similar content. The Services may connect to email accounts you configure, and they may download email messages and related data to your device for local storage and viewing.

4. Your accounts and authentication

You are responsible for maintaining the confidentiality of your device and account credentials, using the Services only with accounts you own or are authorized to access, and reviewing the permissions requested during sign-in.

When you connect a provider using OAuth or a similar authorization flow, you authorize the Services to access your account as needed to provide the selected features. You can revoke access at any time through your provider's security settings or by disconnecting the account in the app.

5. Your content and data

Your content remains yours. Letterboxx Software does not claim ownership of messages, attachments, or other content you access through the Services ("Content").

Depending on your settings and usage, the Services may download and store Content locally on your device; store metadata such as sender, subject, timestamps, message identifiers, and organizational data; and display Content in the app so you can organize and review it.

6. Local storage, backups, and data loss

The Services are designed to store data locally on your device. You are responsible for maintaining your own device backups and exports where available.

To the maximum extent permitted by law, we are not responsible for loss of Content or data caused by device failure, operating system changes, user error, third-party service changes, account lockouts, or connectivity issues.

7. Server-side actions

If you enable or use features that change server state, the Services may perform actions on your email provider such as marking messages read or unread, moving messages to Trash, or applying other organization actions supported by the provider.

Some actions may be irreversible on the provider side. You are responsible for understanding and confirming actions before you initiate them. Some Services may provide settings to limit or disable server-side changes.

8. Acceptable use

You agree not to use the Services to access accounts you are not authorized to access; reverse engineer, decompile, modify, or attempt to extract source code except as allowed by law; interfere with or disrupt the Services or third-party services used by the Services; or use the Services in a way that violates applicable laws or the terms of your provider.

9. Third-party services

Your use of connected third-party services is governed by those services' own terms and privacy policies. Letterboxx Software is not responsible for third-party services, outages, or changes to third-party APIs or protocols that may affect Service functionality.

10. Intellectual property

Letterboxx Software, its logos, design, and software (excluding your Content) are owned by Letterboxx Software LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal or internal business purposes in accordance with these Terms.

11. Paid features, trials, and refunds

If a Service includes paid features, pricing and subscription terms will be presented at the time of purchase. Payments are processed by the relevant platform provider (for example, Apple). Refund requests are handled according to that platform provider's policies.

12. Changes to the Services and these Terms

We may update the Services or these Terms from time to time. If we make material changes, we will update the effective date above and may provide notice in the app or on our website. Continued use of the Services after changes become effective means you accept the updated Terms.

13. Disclaimer of warranties

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be error-free, uninterrupted, or compatible with all third-party services indefinitely.

14. Limitation of liability

To the maximum extent permitted by law, Letterboxx Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Services.

In all cases, our total liability for any claim related to the Services will not exceed the amount you paid to use the Services in the 12 months before the claim (or $50 if you have not paid anything), unless applicable law requires otherwise.

15. Indemnification

You agree to indemnify and hold harmless Letterboxx Software LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your Content, or your violation of these Terms or applicable law.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services if you violate these Terms or if required by law. Sections that by their nature should survive termination (for example, disclaimers and limitation of liability) will survive.

17. Governing law

These Terms are governed by the laws of the State of Iowa, United States, excluding its conflict of laws principles. Any disputes will be brought in the state or federal courts located in Pottawattamie County, Iowa, unless applicable law provides otherwise.
